RECOMMENDATION
Accept the award from 148th Judicial District Court of a 2002 Jeep Grand Cherokee to be used by District Attorney’s Office.
BACKGROUND
The Court approved the use of a 2004 Lincoln Navigator that was donated by the Texas Department of Public Safety.  Acceptance of the donation increased the District Attorney fleet size from two to three. The vehicle requested was to be unmarked and operating expenses will be borne by the District Attorney's Office AF fund (Asset Forfeiture under Chapter 59 fund).  The defense filed a Motion For New Trial, essentially requesting that the Judge overturn it being awarded and returned to the Defendant.  That motion has been granted, but the DA office is appealing it.  The judge ordered the vehicle be parked while litigation is pending.  If the defendant is successful, the vehicle could possibly be returned to him.

The forfeited vehicle was to be used to assist and promote the purposes of the District Attorney’s office. It was to be used as a “pool” car for prosecutors or staff to use to travel to crime scenes, distant areas of the county, to locate and travel to victims and witnesses, to travel to law enforcement agencies both inside or outside the city limits.  It was also to be used as a surveillance vehicle for criminal investigations. It also is to be used for transportation for staff to travel to other cities for continuing legal education or training. It was to be used for the District Attorney or his representative(s) to attend functions sponsored, co-hosted, or requiring their presence such as speaking engagements, community events, legal or law enforcement functions or events. It was also to be used to transport witnesses or victims, if needed. It was to be used in any manner that assists the operation or purposes of the District Attorney’s office.

The Jeep Grand Cherokee would replace the Lincoln Navigator and would keep the fleet size at three.
DISCUSSION
The vehicle is requested to be unmarked and operating expenses will be borne by the District Attorney's Office AF fund (Asset Forfeiture under Chapter 59 fund).
