Approve execution of Supplemental Agreement No. 4 with LNV, Inc. for Engineering Services for RFQ 2977-14 Surface Water Lines and Connections in Cindy Park.
BACKGROUND
On November 18, 2014, the Commissioners Court executed a grant contract with the Texas Department of Agriculture. The project is for the installation of surface water lines and related household connections in the Cindy Park colonia, located off of FM 666 between FM 1833 and CR 48, along Cindy Lane. The residents currently rely on a dilapidated well or do not have a potable water source. On April 1, 2015, the Commissioners Court executed an Engineering Services Contract with LNV, Inc. for engineering services for RFQ 2977-14 surface water lines and connections in Cindy Park. The contract is for a state-registered engineer/engineering firm to design and oversee the implementation of surface water lines to be installed and residents will be given an opportunity to tie into the new water system, if they so wish, at no cost to them since the project is designed to assist those with low-to-moderate incomes. On September 2, 2015, the Court executed Supplemental Agreement No. 1 to add language to the contract in accordance with the Texas Department of Agriculture grant agreement. On November 16, 2016, the Court executed Supplemental Agreement No. 2 to extend LNV’s contract to November 23, 2017. On March 7, 2017, the Court executed Supplemental Agreement No. 3 to extend LNV’s contract to July 23, 2018.
DISCUSSION
The Texas Department of Agriculture (TDA) has granted Nueces County an 18-month extension for this project in order to fully expend the grant funds. The County’s deadline to submit closeout paperwork on this project is July 23, 2018, which is also LNV’s current contract end date. However, it is possible that TDA may have questions after the closeout documents are submitted so we would like to extend LNV’s contract end date to September 23, 2018 to allow them to be able to assist the County in answering any technical questions regarding the project. LNV’s contract amount will remain the same. This project is being paid from Texas Community Development Block Grant funds, County Department #2792. Form 1295 Certificate No 2018-340496 was provided.
