Interlocal Agreement with CSCD for Pre-Trial Assessment Program

Discuss and consider the execution of an interlocal agreement between Nueces County and the Community Supervisions and Corrections Department in relation to the FY 2018 Technical Support Grant/Pre-Trial Assessment Initiative.
The Texas Indigent Defense Commission (TIDC) was created to allow the state courts system to collaborate with local courts and counties to improve indigent defense services available in the counties’ courts. Pursuant to Texas Government Code §79.037, the Commission makes payments, including grants, to counties to provide indigent defense services.
On October 25, 2017, the Commissioners Court ratified the execution of a Statement of Grant Award from the Texas Indigent Defense Commission for the FY2018 Technical Support Grant/Pre-Trial Assessment Initiative.
The new pre-trial risk assessment project was created in an effort to improve coordination of indigent defense processes and to reduce unnecessary and costly pre-trial detention. The program consists of two staff positions to be under the supervision of the District Courts and Adult Probation Department, equipment for said staff, and a research component to assess the impact of the program.
Nueces County was approved for 75% of salary & benefit costs, 100% of start-up equipment costs, and 100% of contract services for research/evaluation. The grant award is $160,000 with a County match required of $37,440, bringing the total projects costs to $197,440. The grant period will begin on October 1, 2017 and end on December 31, 2018.
The proposed Interlocal Agreement will reimburse CSCD for the 75% of salary and benefit costs.
