Transfer Guardianship Asst CCL5 position to District Clerk's Office

Discuss and consider the transfer of Guardian Assistant position currently in County Court at Law No. 5 to the District Clerk to be in compliance with Section 51.316 of the Texas Government Code.
The Guardian Assistant at County Court at Law 5 is deputized by the District Clerk, signs documents on behalf of the District Clerk and uses District Clerk stamps. However, she is not an employee of the District Clerk but an employee of County Court at Law 5. An opinion by the County Attorney states that unless this position is in the District Clerk's Office, the Guardian Assistant cannot use the seals, sign documents or be "sworn in" as a Deputy Clerk. Also, unless this position is the District Clerk's Office, rights cannot be given to the Probate Assistant to report guardian information into Civil Odyssey and reported to the Office of Court Administration thus threatening receipt of grant monies. Judge Timothy McCoy has agreed to the transfer of this position to the District Clerk's Office.
