RECOMMENDATION
Discuss and consider approving a Data Use Agreement as part of the contract with the Texas Department of State Health Services (DSHS), an agency of the State of Texas, under which DSHS provides, gives access to, or transmits confidential information to its contractors.
BACKGROUND
Due to changes in Federal law, the Texas Department of Health Services (DSHS) is requiring its contractors to execute a Data Use Agreement to continue to provide, give access, or transmit confidential information to its contractors.  Since the requirement for having a DUA is mandatory by law, failure to execute a DUA may result in suspension of our current contract.

Nueces County currently has a contract with DSHS for remote access to the State's vital records database.  Under the current contract, the County Clerk's office has the ability to log on to the department's vital records database, conduct a search for the vital record, and once located, print the record in the County Clerk's office using special bank note paper maintained by the county.

The County Clerk's office issues an average of 300 certificates per month through this remote access process and assesses a charge of $22.00 per certified copy of a vital record.
