Brownfields Response Program (BRP) Application

Discuss and consider submission of a Brownfields Response Program (BRP) application with the Railroad Commission of Texas.
In October 2014 during construction and development of wetlands at the Fairgrounds, the contractor, G&L Young Construction Company, encountered oil in the subsurface. After testing it was determined that hydrocarbon contamination was due to crude oil. Under the Texas Railroad Commission (RRC) Rules, Nueces County is considered an “Innocent Landowner” so the County is not under any enforcement mandates, but the site must be remediated to the RRC’s standards.
By filing the BRP application, the RRC will fund Phase I and Phase II Environmental Site Assessments to determine the extent of the contamination and propose a remediation technique. No fiscal impact.
