Discuss and consider authorizing the County Judge to send a letter by certified mail to the Texas Comptroller detailing the legal authority of Nueces County to exercise the power of eminent domain, as required by Section 2206.101 of the Texas Government Code.
Senate Bill 18, enacted in the most recent legislative session, requires all public and private entities authorized to exercise the power of eminent domain in Texas to submit a letter by certified mail to the Texas Comptroller of Public Accounts detailing their legal authority to exercise this power. The letter must be sent by December 31, 2012 or the eminent domain authority expires.
Nueces County has numerous statutes that authorize it to exercise the power of eminent domain to acquire property that is necessary to accomplish the duties responsibilities of the county. If the letter is not sent by December 31, 2012, all authority of Nueces County to exercise the power of eminent domain expires on September 1, 2013.
Nueces County will lose the authority to exercise the power of eminent domain if the letter is not sent.
